Order The Secretary of Health and Human Services (HHS) formerly Health, Education and Welfare (HEW) has appealed to this court from an order of the district court granting a preliminary injunction requiring HHS to renew an annual grant of support to plaintiff North Memphis Community Health Organization (NMCHO), under Section 330 of the Public Health Services Act, 42 U.S.C. Â§ 254c. NMCHO had received successive grants to support its operations from July 1972 to November 30, 1979. HHS declined to award NMCHO a continuation grant after November 30, 1979, when the budget and projects periods of its grant expired. It contends that the decision of HHS not to award it a continuation grant without affording it prior notice and a hearing violated its due process rights under the Constitution of the United States as well as its own policies, procedures and regulations.
